The San Marcos Deck Permit Guide
The City of San Marcos lists decks under its building permits, but it does not post a size or height that decides when you need one, so the answer is to ask the city.

Inside City Limits
The city permit page groups decks with pools, signs and fences under building and site permits. It does not give a size, a height or a cost that sets the line. It also does not name patio covers or pergolas.
When it is not clear whether you need a permit, the city points you to its Permit Requirement Determination Form. You can also email permitinfo@sanmarcostx.gov or call 512.805.2630 for guidance. We use the same path on every job in town.
Outside City Limits
Plenty of San Marcos addresses sit outside the city. There, Hays County runs development permits. The county says it requires a permit for any kind of development, so it can stay in the National Flood Insurance Program. Its list of development includes foundation work and grading.
So if your lot is in the county, check with Hays County Development Services before you build. This matters most on low lots near creeks and the river.
The Edwards Aquifer
Parts of Hays County sit on the recharge and contributing zones of the Edwards Aquifer. TCEQ says construction at private homes in those zones falls under its Edwards Aquifer rules in 30 TAC Chapter 213. Hays County is one of the counties in its Austin region.
Not every lot is in a zone. If yours is, ask what the rules mean for your project before work starts.
Call Before You Dig
Deck and pergola footings mean holes in the ground. Texas law asks you to notify the one call center (dial 811) no earlier than 14 days and no later than 48 hours before you dig. Weekends and legal holidays do not count toward the 48 hours. The law covers digging 16 inches or deeper with powered equipment.
We file the locate on our jobs and wait for the marks before any hole goes in.
Live Oaks and Oak Wilt
Many San Marcos yards have big oaks right where the deck wants to go. The Texas Oak Wilt Partnership says to avoid pruning or wounding oaks from February 1 through June 30. It counts construction damage as a wound. We plan root cuts and limb work around that window.
HOA Rules
Many neighborhoods have an HOA with its own approval step for decks and covers. Rules differ from one HOA to the next. Ask your HOA for its approval form and timeline early, because approval can take longer than the permit.
